New Twinning Project of the Macedonian State Environmental Inspectorate
The Twinning Programme
The new project is part of the Twinning Programme of the European Commission. The programme, which was created in 1998, provides a framework for public administrations and semi-public organisations in the beneficiary countries to work with their counterparts in EU member states. The main feature of a twinning project is that it delivers specific and guaranteed results. The parties agree in advance on a detailed work programme to meet an objective related to priority areas of EU legislation, as set out in each candidate country's accession partnership (the pre-accession strategy instrument that determines the country's particular needs on which pre-accession assistance should be targeted).
Project background and context
One of the main targets of the Ministry of Environment and Physical Planning is to improve the implementation of and compliance with environmental legislation among Macedonian citizens, industries and other stakeholders. For this purpose, a set of three EU-cofinanced actions was designed: (i) the present twinning project to support the environmental inspection system at central and local levels; (ii) a technical assistance project to support the implementation of environmental legislation in municipalities' fields of responsibility; and (iii) a supply contract providing equipment and software to improve the working conditions of environmental inspectors at central and municipal levels. The three actions are being implemented between 2015 and 2016.
To achieve the overall target of contributing to the improvement of environmental protection in the country at both central and local levels, this project aims to enhance the capacities of environmental inspection bodies for the enforcement of environmental legislation at central level (the State Environmental Inspectorate) and at local level (municipalities).
The project goals are therefore to:
- determine the optimal institutional framework for an effective environmental inspection system;
- review and improve the legislative framework related to environmental enforcement;
- improve the practices of inspection bodies through better planning and training; and
- deliver or support the elaboration of a variety of tools, such as a website, information management system, guides for inspectors and industrial owners, and checklists for specific sectors.
Project kick-off meeting
The project has three components:
- Strengthening administrative capacities for the enforcement of environmental legislation
- A legal and institutional assessment of the current environmental inspection and enforcement system will be performed. Based on this assessment, recommendations for improvements will be made and a programme for strengthening the administrative capacities of environmental inspection bodies will be prepared.
- Guides for inspectors and industrial owners and checklists for specific industrial activities or environmental issues will be created.
- Training materials will be prepared and a training programme will be implemented.
- Study tours will be organised to EU member states (Spain, Portugal and the Netherlands).
- Improving the effectiveness of the environmental enforcement system
- A new Law on Environmental Inspection will be drafted. Gaps in related environmental legislation will be identified.
- A risk-based planning methodology will be discussed.
- A website for the State Environmental Inspectorate (SEI) and the project will be developed.
- A series of field inspections, including joint inspections, will be carried out, with a focus on issues related to IPPC/IED and air and water quality.
- EU recommendations on environmental inspection will be transposed, training curricula prepared, and training delivered on implementation.
- Improving the management information reporting system (MIRS) for inspection:
- The MIRS delivered in keeping with the supply contract described above (Project background and context) will be analysed and recommendations made for its optimisation.
- The risk assessment planning software tool IRAM will be discussed.
Alongside the work with environmental competent authorities there will be interaction with other stakeholders, such as industry, NGOs and the general public, during the implementation of activities.
Under the IPA Supply element of the project, the SEI, municipalities and the ministry were granted a further EUR 750,000, 12 cars, 110 desk-top PCs, 14 lap-top computers, printers, scanners, a projector, VOiP video conference call equipment, business process management system (BPMS) software for e-inspectorate management, special equipment for the indicative measurement of PM10, multi-gas analysers, sound meters and software for noise mapping in four selected cities (Skopje, Bitola, Kumanovo and Tetovo) as well as water-related equipment.
